telecommunications sector. First we have an auction that was supposed to draw interest from far and wide. In the end, the xenophobic clauses in the bid instruction manual meant that only the three incumbents bothered to tender bids, but that was all moot as the auction was stopped on a technicality - there was no frequency master plan and the regulator could not proceed without </span><span style='font-size:10.0pt;font-family:"Tahoma","sans-serif";mso-fareast-font-family: "Times New Roman";color:#000066'>one</span><span style='font-size:10.0pt; font-family:"Tahoma","sans-serif";mso-fareast-font-family:"Times New Roman"; color:#003366'>.</span><span style='mso-fareast-font-family:"Times New Roman"; color:#6B8BAA'><o:p></o:p></span></p> </div> <p class=MsoNormal style='text-align:justify'><span style='mso-fareast-font-family: "Times New Roman";color:#6B8BAA'><br> &nbsp;<o:p></o:p></span></p> </td> </tr> <tr style='mso-yfti-irow:1;mso-yfti-lastrow:yes'> <td colspan=2 style='padding:0in 0in 0in 0in'> <div> <p class=MsoNormal style='text-align:justify'><span style='font-size: 10.0pt;font-family:"Tahoma","sans-serif";mso-fareast-font-family:"Times New Roman"; color:#000066'>It was a technicality and the NTC quickly moved to set up a committee to draft the frequency master plan, never mind the knot it was getting itself into as it set up the committee days before it became acting National Broadcasting and Telecommunications Commission (NBTC), under the new Frequency Allocation Act and thus arguably without the authority to do so.<br> <br> As for the new Frequency Allocation Act. One can only marvel whether the climax of the debacle was how it backed off dealing with the issue of concessions or if it was how Finance Minister Korn Chartikavanij was shouted down whilst defending it, not from the opposition, but from his fellow Democrat party members Satit and Chuti who were opposed to deregulation and the reduced powers they would have as ministers for media and telecoms, respectively.<br> <br> Even then, the final draft of the Frequency Allocation Act was not the dawn of a new era in telecommunications that was promised, but the final nail in the coffin for any hope of reform or of a fair and level playing field.<br> <br> Years of negotiations centred around article 84 (or 78 in most of the drafts), namely, the de-coupling of revenue share (a state domain asset) from the state owned enterprises, CAT and TOT. The draft that the house passed did that and called for the 2G revenue share to be severed from the SOEs and directed to the Ministry of Finance. However, at the senate level, the one year s grace period (for accounting purposes) was not only extended to three years, but worse, a provision was added that allowed SOEs to withhold  costs and USO projects thereafter.<br> <br> Concession conversion, or as Tore Johnsen (Dtac CEO) likes to put it, concession termination is not just a fancy way of accounting, but it is as much about liberalising the telecoms sector as anything else. Without termination of the concessions, huge swathes of spectrum will remain in the de-facto control of the two state owned enterprises perpetually.<br> <br> Mainstream media focuses on the concessions versus the licences in terms of revenue share. Concessions are subject to a 20 to 30 percent cut of revenue whereas the NTC said it would charge just 6 percent as a licensing fee in its aborted 3G bid. Economics would make people naturally move off 2G to 3G because of the lower tax.<br> <br> Much of the argument against 3G would be the so-called loss that CAT and TOT would take if 3G licensing went ahead and users migrated to a lower taxed system for plain vanilla voice calls.<br> <br> This argument is flawed on so many levels. First off, the tax should not belong to CAT and TOT (though everyone seems to think it does), the two state owned enterprises are simply acting as a tax collector and not a very good one at that. The tax, and indeed the concessions themselves, should belong directly to the state as they are state domain assets - assets that state organs gained through state power and not through business operations. The argument has been proven in courts. When state oil company PTT was privatised, the gas pipeline network was initially transferred to PTT before it was challenged in court and then returned to the Ministry of Finance.<br> <br> The other level is that in attempting to protect the revenue of CAT and TOT, the NTC in its aborted 3G bid put in so many clauses that would have made the 3G network impractical (or at least prohibitively expensive) to deter people from moving to the lower tax regime (that would happen to be faster, too). These clauses were that the bidders could not use their existing core network and would have to lease core networks from CAT and TOT (never mind the fact they had the country wired with fibre for their 2G networks anyway), no roaming from 2G to 3G (to prevent people who want just voice automatically changing to the 6 percent tax and then the level-playing field icing on the cake was that TOT would be exempt from the no-roaming clause), return of 2G frequency (how returning 2G frequency suddenly became part of a 3G bid does not make sense to anyone).<br> <br> In other words, the only way to preserve 2G revenue share would be to erect barriers around 3G to make it more expensive for no particular reason other than to keep 2G alive.<br> <br> The NTC had resorted to regulating the industry and was trying, ham-fistedly, to enact reform via threats of exclusion from the 3G as they had no other way of influencing the incumbents.<br> But &nbsp;back to the point of concession conversion.<br> <br> When a telco rolls out a new network under the current concession agreements, it is (supposed to be) under a build transfer operate agreement. The new network equipment has to be transferred to the concession holder first and then is leased back.&nbsp; This situation leads to two major problems.<br> <br> First is that the concession holder has undue influence and is de facto regulator rather than the NTC (or NBTC). Take 3G. Dtac told CAT back in 2007 that it was going to upgrade its existing legacy 1G 800 MHz AMPS network (yes, it has one) to 3G. CAT initially demanded a whole series of conditions that went far beyond the concession agreements. Dtac said that they were telling CAT of an upgrade to something they considered was theirs; they were not asking to enter negotiations for something. Four years later, CAT still has not decided one way or the other whether to allow the upgrade as per the original plan, only recently fudging something about a non-commercial trial of 3,500 sites.<br> <br> The NTC said that what happens to 850 is a matter for CAT. Thus, because of the status quo of the concessions, Thailand has been denied 3G that could have happened four years ago. CAT is de-facto regulator and regulated through running the clock out. It is unanswerable to anyone because it  owns the concessions. Case closed and there is nothing the regulator can do except ask nicely for everyone to get along for the country.<br> <br> The second major problem is how to move on. Take this scenario. A 3G subscriber makes a voice call and drives down the road. 3G coverage is patchy and it falls back to 2G, then up to 3G again and so on and so forth. Accounting and billing for such a call would be a huge headache. Then there is the issue of re-using existing infrastructure. Modern cellsites can be upgraded with a simple firmware upgrade (or firmware and radio upgrade) to 3G or 4G, but how can something that would have to be returned in a couple of years be upgraded? The only way forward would be to build a new, separate infrastructure at great cost. Investors are not investing for the joy they bring to bureaucratic bean counters, but for profit and in order to make a profit someone has to pay and that would be the Thai consumer.<br> <br> Thailand had a once in a lifetime chance to right these wrongs and sort out everything once and for all. The vision for concession termination was for all the concessions to be terminated at the same time and for licences to be issued for 2G networks. With a licence and no concession owner breathing down their neck, the 2G networks could be upgraded to 3G in line with what has happened in most countries and in a cost effective way. It was a once in a lifetime chance as the concessions were ending soon anyway; the Ministry of Finance and Ministry of ICT were from the same party and the country had a dashing young Prime Minister who stood for transparency and rule of law.<br> <br> But that did not happen. Ultimately it boiled down to business and politics as usual.<br> <br> There was too much money at stake from forces who preferred to see the status quo continue and for things to end in a mess when concessions end with no way out. Politicians profit most when rush decisions have to be made without due process.<br> <br> Just why did CAT approve within months, if not weeks, True s purchase of Hutch and the re-purposing of its CDMA EV-DO network to HSPA 3G? After all, Dtac tried the same with the AMPS frequency it already had (whereas True had to take over Hutch to get at it) and four years later, CAT has not made up its mind.<br> <br> Could it be unreasonable to suspect that the upcoming elections had something to play in the expedited decision making?<br> The other 3G network, that of TOT, is surrounded in no less controversy. Ericsson was kicked out for not having pictures of its antennas in the bid pack and ZTE was kicked out for offering too much capacity. The Samart-Loxley NSN Huawei consortium won the bid.<br> <br> As if that was not fun enough, there is now the subject of the on-again, off-again case against AIS and the concession contract amendments. Whatever else is argued, the bottom line is that the owner of AIS at the time and the one who changed the law were sharing the same bed. But that is now all forgotten as the Thai collective conscious forgets about ancient history and focuses on the here and now.<br> <br> What happens next? 2G services will become worse and worse - after all, why bother upgrading a network that has to be handed back soon, while the 3G duopoly between the two state owned enterprises will mean a return to the good old days when the bureaucrats ran the show and phones were expensive and not that pervasive. Nothing will change for at least three years as that is the period where the two state owned enterprises will continue to benefit from revenue share. The two will do everything to block reform and in the meantime hoard up on as much spectrum as they can. Already, Thailand s 4G spectrum is all but fully used by TOT in a very inefficient manner.<br> <br> The people of Thailand deserve better, but without education, without knowledge, nothing will change. Today the elected officials think that a strong CAT and TOT through protectionism is the answer to the evil Shingaporeans and Telenorweigans and the public in general seem to believe that.
